Got nice Xmas present from work

I was awarded an iPad 2 for having a "Can Do Attitude" at my employer's Christmas party. My wife and I left early, so I didn't know I had won it, until I got to work the next Monday. I was pleasantly surprised! I've never got any sort of present from any employer before. My boss, the CTO, teased me mercilessly all day Monday, about not being there at the party. I can take the teasing for an iPad 2.  ;)

Nice.

My last client handed out expensive ($250) fountain pens for some project.  A few weeks later everyone got a note saying that the pen counted as income so a few bucks would be deducted from their next paycheck to cover the tax.

Deja Vu all over again. My nephew just told me that his employer deducted almost $1,900 from his 23 December  paycheck. All year he's been winning sales awards -- 2 flat screen TVs, tickets to sporting events, a trip to Cancun. And now they've decided all that swag was taxable income and withheld taxes.  Just their way of saying "Merry Christmas."

Unfortunately, when an employer gives a "gift", it is all taxable. Let me quote from the IRS web site:

What is considered a gift?
Any transfer to an individual, either directly or indirectly, where full consideration (measured in money or money's worth) is not received in return.

What can be excluded from gifts?
The general rule is that any gift is a taxable gift. However, there are many exceptions to this rule. Generally, the following gifts are not taxable gifts.

Gifts that are not more than the annual exclusion for the calendar year.
Tuition or medical expenses you pay for someone (the educational and medical exclusions).
Gifts to your spouse.
Gifts to a political organization for its use.
In addition to this, gifts to qualifying charities are deductible from the value of the gift(s) made.

IRS says that gifts from an employer are "fringe benefits" and thus are taxable.

Holiday gifts.   If your employer gives you a turkey, ham, or other item of nominal value at Christmas or other holidays, do not include the value of the gift in your income. However, if your employer gives you cash, a gift certificate, or a similar item that you easily can exchange for cash, you include the value of that gift as extra salary or wages regardless of the amount involved.

I figure that an iPad2 is easily exchanged for cash. Thus, it would be taxable.
